Terms & Conditions 

 

1. General  

 

1.1. Welcome to Dragonpass International Limited’s ("Dragonpass") Terms and Conditions ("Terms and Conditions" or “Terms”) page.  

 

1.2. The Services (as defined below) are provided by Dragonpass International Limited, located at 173a Ashley Road, Hale, Altrincham, Cheshire, WA15 9SD, United Kingdom, or its affiliated companies.  

 

1.3. When you read these Terms and Conditions, please note that the terms “you”, “your” and “User(s)” refer to the person(s) named on the Card(s). The terms “we”, “our”, “us” and “Dragonpass” refer to Dragonpass International Limited and its affiliates, successors and assigns. If you are the individual requesting us to issue the Card(s) to you, you will be known as the “Dragonpass Member” and you will have an account with us called the “Card Account”.  

 

1.4. By using our Services, you are agreeing to these Terms, as well as our Privacy Policy (accessible at https://www.dragonpass.com/privacy-policy) and Terms of Use (accessible at https://www.dragonpass.com/terms-of-use), all of which will constitute a binding agreement between Dragonpass and you when you use any of our Services. Accordingly, please review them before using any of our Services, and in the event that you do not agree with any provision(s) contained therein, please do not use (or please discontinue to use, as the case may be) our Services. Take note however that in such an event, no refund of any kind will be provided to you.  

 

2. Definitions  

 

2.1. In these Terms and Conditions: 

 

2.1.1. “Dining Discount(s)” means certain discounts, offers and privileges offered at Participating Merchant Outlets for food and beverages for Dragonpass Members.  

 

2.1.2. “Dining Voucher(s)” refers to the mode of payment services available on the Dragonpass App made available by Dragonpass for purchases made by Dragonpass Members at Participating Merchant Outlets.  

 

2.1.3. “Dragonpass Membership Card” means any membership card bearing the name Dragonpass and/or the service mark of Dragonpass issued by us pursuant to these Terms and Conditions, including any substitution, replacement or renewal thereof.  

2.1.2. “Dragonpass Website” and “Dragonpass App” means respectively the main/official website of Dragonpass and the mobile application known as the Dragonpass/DP Global App (“Dragonpass App” or “App”), and therefore “Dragonpass Website or App” refers to either the said website or App.  

 

2.1.3. “e-SIM” means the e-SIM services offered and/or available to Dragonpass Members by Dragonpass, as supplied by its third-party provider, e-SIM Go.  

 

2.1.4. “Fast Track Service” or “FT Security Fast Track Program” or “Fast Track” means the fast track services at Participating Merchant Outlets at airports and railway stations, which includes (but is not limited to) airport security fast track and passport control fast track lanes, which are offered and/or available to Dragonpass Members.  

 

2.1.5. “Fitness Service” or “Fitness” means the fitness services offered and/or available to Dragonpass Members at Participating Merchant Outlets which includes, but is not limited to, gym classes and single-use day passes. 

 

2.1.6. “Flight Delay” means the flight delay services offered and/or available to Dragonpass Members which entitles you to lounge access at Participating Merchant Outlets in the event of a delayed flight.  

 

2.1.7. “Limousine” means limousine and/or transport services offered and/or available to Dragonpass Members by Dragonpass, as provided by Participating Merchant Outlets, including but not limited to airport transfers, chauffeur services, and other transport services. 

 

2.1.8. “Multi-purpose Voucher” or “MPV” means a multi-purpose voucher that allows Dragonpass Members to redeem lounge entitlements at selected dining and retail locations. 

 

2.1.9. “Participating Merchant Outlets” refers to third party service and facility providers (including without limitation, airport lounge operators, restaurants and fast track operators) participating in and providing their services and products thereunder the Services. For the avoidance of doubt, Participating Merchant Outlets are not subcontractors, agents or representatives of Dragonpass, nor are they under the supervision or control of Dragonpass, and as such you agree that Dragonpass bears no responsibility or liability for the acts or omissions or the quality (or any other aspect) of the services or products of Participating Merchant Outlets.  

 

2.1.10. “Retail Discount(s)” means certain discounts, offers and privileges offered at Participating Merchant Outlets for retail services for Dragonpass Members.  

 

2.1.11. “Standard Lounge Access” means lounge services provided at Participating Merchant Outlets at airports and railway stations, which includes (but is not limited to) the supply of food and beverages, access to the internet, newspapers and magazines, and the usage of VIP rooms at said lounges, for Dragonpass Members.  

 

3. Dragonpass Services  

 

3.1. We provide the following services ("Services") to DragonPass Members:  

 

3.1.1. Dining Discounts and Promotions;  

 

3.1.2. Dining Vouchers and Set Meals;  

 

3.1.3. e-SIM;  

 

3.1.4. Fast Track;  

 

3.1.5. Fitness;  

 

3.1.6. Flight Delay; 

 

3.1.7. Limousine;  

 

3.1.8. Multi-purpose Vouchers;  

 

3.1.9. Retail Discounts and Promotions; and  

 

3.1.10. Standard Lounge Access.  

 

4. Registration of Dragonpass Account  

 

4.1. You are obliged to provide complete and truthful information at all times when registering for a Card Account.  

 

4.2. To register for Dragonpass Membership and access the Services, you need to be 18 (eighteen) years old or older, have the power to enter into a binding agreement with us, and not be barred from doing so under any applicable laws. You also promise that any registration information that you submit to Dragonpass is true, accurate, and complete, and you agree to keep it that way at all times. Accordingly, in the event of any changes, you undertake to promptly update your registration and Card Account information as soon as reasonably possible. 

 

4.3. Dragonpass has the right to suspend or terminate your Card Account at its sole discretion immediately with no refund (whether in whole or in part), no membership duration extension, and/or other compensation of any kind if information provided by you is considered by Dragonpass in its sole and reasonable discretion to be false, incorrect and/or incomplete.  

 

4.4. You are solely responsible to maintain and protect your Card Account information.  

 

4.5. Dragonpass will not be held responsible if your Card Account is terminated due to account information not being updated.  

 

4.6. You are not allowed to transfer your Dragonpass Membership before or after registration to any other persons.  

 

4.7. Notwithstanding any other provisions in these Terms and Conditions, Dragonpass has no responsibility to verify whether any instructions, requests or transactions received by Dragonpass via your Card Account are in actuality made or authorized by you, and therefore you undertake to remain fully liable for all acts, omissions and/or transactions made through your account.  

 

4.8. You may at any time choose to delete your Card Account in-app or via our website at https://dragonpassgo.com/delete-account/index, however, thereafter deletion, you will no longer be able to access any of our Services, we will not be able to fulfil any transactions that you have submitted to us (even if payment has already been made), and no refunds or other compensation of any kind will be provided to you.  

 

5. Dragonpass Membership Validity Period  

 

5.1. If you bought your Dragonpass Membership directly from Dragonpass, it will need to be activated within 1 (one) year of the day on which you purchased the membership. If your Dragonpass Membership is not activated within the stipulated period, it will be terminated without any refund, extension of duration, or compensation of any kind.  

5.2. All Dragonpass Memberships will have a validity of 1 (one) year after it has been activated, during which you will be able to enjoy all Dragonpass Services (subject to variation from time to time in Dragonpass’ sole discretion without prior notice to you). Additional costs may apply for certain Services or products.  

 

5.3. Once your Dragonpass Membership has expired, you will no longer be entitled to the Services and Dragonpass will immediately stop rendering all such Services to you. You may choose to extend your Dragonpass Membership by paying a membership fee at the then prevailing rate.  

 

5.4. If you procured your Dragonpass Membership through another third party (your “Provider”) such as (but not limited to) a bank or issuer as a benefit, the above may not be applicable to you. The validity of your Dragonpass Membership may vary depending on your Provider. Please check your Provider’s own terms and conditions in this regard.  

 

6. FAIR USAGE  

 

6.1. Responsible Use:  

 

6.1.1. Users agree to use their Dragonpass Membership responsibly and in compliance with applicable laws and regulations. Unlawful, unethical, or irresponsible use of the Services is strictly prohibited.  

 

6.2. Non-Abuse:  

 

6.2.1. Users shall not engage in any activities that may abuse or exploit the resources of Dragonpass. This includes, but is not limited to, any form of excessive usage that may impact the performance or availability of the Services for other Users.  

 

6.3. Reasonable Limits:  

 

6.3.1. While we strive to provide high-quality Services, Users acknowledge and agree that Dragonpass may impose reasonable limitations on usage, including but not limited to bandwidth, storage, and other resources, to ensure fair and equal access to all Users.  

 

6.4. Monitoring and Enforcement: 

 

6.4.1. Dragonpass reserves the right to monitor the usage of its Services to ensure compliance with these Terms. If, in its sole discretion, Dragonpass determines that a User is in violation of this Fair Usage Clause, Dragonpass may take appropriate actions, including but not limited to warning, suspension, or termination of the User's Card Account or access to the Services.  

 

6.5. Communication:  

 

6.5.1. Users engaging in activities that may be deemed excessive or abusive will be contacted by Dragonpass to discuss and resolve the issue. Users are encouraged to communicate with Dragonpass to address any concerns related to fair usage.  

 

6.6. Updates to Fair Usage Policy:  

 

6.6.1. Dragonpass reserves the right to update, modify, or revise this Fair Usage Clause at any time without notice. Users agree that they are responsible for regularly checking these Terms and Conditions (which include this Fair Usage Clause) for any updates, and continued use of any of the Services after such updates have been published will constitute acceptance of the updated Terms.

6.7.2. By using our Services, Users acknowledge that they have read, understood, and agreed to abide by the Terms outlined in this Fair Usage Clause.  

 

7. Dragonpass Service Regulation  

 

7.1. General  

 

7.1.1. Dragonpass Membership is not transferable and is only valid up to its date of expiry. The membership may not be used by any person other than the named Cardholder.  

 

7.1.2. All Dragonpass Memberships purchased from the Dragonpass website and/or App are non-refundable. Payment must be made online or when billed, which can be up to 6 (six) months after purchase (whether for membership or any Services that are chargeable). For Dragonpass Memberships and products/services thereunder that are purchased from other channels or Providers, such services/products may be subject to such respective channel or Provider’s applicable terms and conditions.  

 

7.1.3. You are required to sign at the back of your physical Dragonpass Membership Card (If applicable).  

 

7.2. Dining Discounts and Promotions  

 

7.2.1. All offers, privileges and/or promotions are open to all Dragonpass Members unless otherwise stated.  

 

7.2.2. To enjoy the offers, please present your digital Dragonpass redemption page. A list of Participating Merchant Outlets is available on the Dragonpass Website and App. 

 

7.2.3. All offers, privileges and/or promotions are subject to availability and a while-stocks-last basis.  

 

7.2.4. All offers, promotions and discounts listed may be subject to prevailing government taxes and service charges, where applicable.  

 

7.2.5. All offers, discounts and promotions are not exchangeable for cash, credit or other goods and services and are non-transferable.  

 

7.2.6. Please present your digital Dragonpass redemption page prior to ordering or payment.  

 

7.2.7. All complimentary gifts or items (if any) are provided on a while-stocks-last basis and are not refundable or exchangeable for cash, credit or other items of any kind and are not transferable.  

 

7.2.8. Dragonpass and its Participating Merchant Outlets reserve the right to replace any complimentary gift or item (with an item of similar value) if it is unavailable at the time of purchase/confirmation of order, where applicable, without prior notice to Users.  

 

7.2.9. All offers, promotions or discounts listed are subject to the applicable Participating Merchant Outlet’s terms and conditions.  

 

7.2.10. Participating Merchant Outlet’s reserve the right to amend the terms and conditions governing the offers, discounts or promotions at any time without prior notice.  

 

7.2.11. Goods and/or services (including any complimentary gifts) are provided solely by the Participating Merchant Outlets, under such terms and conditions as determined by such Participating Merchant Outlets, and accordingly Dragonpass makes no warranty or representation as to the quality, merchantability or fitness for purpose (even if advised in advance of such purpose) of the Participating Merchant Outlet’s goods and/or services (including any complimentary gifts).  

 

7.2.12. All disputes or feedback in relation to the goods and/or services of the Participating Merchant Outlets (such as quality, taste, etc.) should be directed to the relevant Participating Merchant Outlet and resolved directly between the Dragonpass Member and the Participating Merchant Outlet. However, for the avoidance of doubt, the Dragonpass Member’s entitlement to benefits such as dining discounts, vouchers, etc., as reflected in his/her Card Account are correct, and as such, please do not raise any disputes with the Participating Merchant Outlets regarding your Dragonpass Membership entitlements as they will not be able to assist you in this regard.  

 

7.2.13. Dragonpass’ decision on all matters relating to the offers, discounts and/or promotions shall be final and binding and no further correspondence will be entertained in regard thereto.  

 

7.2.14. Dragonpass reserves the right to amend, revoke, vary or add to the terms and conditions of any promotion or terminate any promotion or any of its governing terms in its absolute discretion at any time without any liability.  

 

7.2.15. Dragonpass shall not be liable for any misuse, damage or death in relation to any promotional item, discount or offer, and any such instances will need to be raised directly with the relevant Participating Merchant Outlet. 

 

7.3. Dining Vouchers and Set Meals  

 

7.3.1. You are required to be physically present and present your boarding pass, together with your Dragonpass Membership Card, to enjoy this Service. The name displayed on the Dragonpass Membership Card will also need to correspond to the name displayed on the boarding pass in question. In the event that there is any discrepancy between the name displayed on the Dragonpass Membership Card and the boarding pass, you will not be entitled to enjoy the Service. For the avoidance of doubt, stand-by and crew tickets will not constitute valid boarding passes and will not entitle you to enjoy this Service.

 

7.3.2. The redemption page must be verified by the restaurant staff in order to use the restaurant Dining Voucher or Set Meal.  

 

7.3.3. Dining Vouchers and Set Meals may only be used at Participating Merchant Outlet restaurants within the Dragonpass network. The list of restaurants displayed (at any point in time) in the Dragonpass App shall prevail.  

 

7.3.4. Dragonpass and its Participating Merchant Outlets reserve the right to replace the Dining Voucher and/or Set Meal (with an item of similar value) if it is unavailable at the time of purchase/confirmation of order, where applicable, without prior notice to the User.  

 

7.3.5. It is advisable to check and confirm with the restaurant prior to redeeming any offers and prior to ordering.  

 

7.3.6. Redemptions will be applied against your entitlement count as displayed in the Dragonpass App.  

 

7.3.7. No refund, cashback or credit will be offered in the event that the final bill is applied/issued and there is an outstanding sum remaining on the Voucher.  

 

7.3.8. All entitlements/Vouchers are not exchangeable for cash, credit or other goods and services, and are non-transferable.  

 

7.3.9. Vouchers can be applied at the Participating Merchant Outlets subject to their prevailing terms and conditions and certain local restrictions such as taxes, tips and alcohol (as may be applicable).  

 

7.3.10. Cancellations post-transaction shall be at the sole discretion of the staff of a particular Participating Merchant Outlet.  

 

7.3.11. All Dining Vouchers listed are subject to the applicable Participating Merchant Outlet’s terms and conditions. Participating Merchant Outlets reserve the right to amend the terms and conditions governing the offers, privileges and/or promotions at any time without prior notice.  

 

7.3.12. Goods and/or services (including any complimentary gifts) are provided solely by the Participating Merchant Outlets, under such terms and conditions as determined by such Participating Merchant Outlets. Dragonpass make no warranty or representation as to the quality, merchantability or fitness for purpose (even if advised in advance of such purpose) of the Participating Merchant Outlet’s goods and/or services (including any complimentary gifts).  

 

7.3.13. All disputes or feedback in relation to the Participating Merchant Outlets and/or their goods and services should be directed to the relevant Participating Merchant Outlet and shall be resolved directly between the User and the relevant Participating Merchant Outlet. Dragonpass shall not take any part in and shall have no responsibility in relation thereto.  

 

7.3.14. The Dragonpass system allows for redemptions and therefore the system will allow or disallow the redemptions based on fair usage and/or remaining entitlements.  

 

7.3.15. Dragonpass’ decision on all matters relating to the offers, discounts, privileges and/or promotions are final and binding and no further correspondence will be entertained in relation thereto.  

 

7.3.16. Dragonpass reserves the right to amend, revoke, vary or add to the terms and conditions of any discount, offer and/or promotion, or terminate any such discount, offer and/or promotion or any of its governing terms in its absolute and sole discretion at any time without any liability or notice.  

 

7.3.17. Dragonpass is not involved and does not participate in establishing the prices of the services and products offered by Participating Merchant Outlets or the actual services and products described, nor does it have any responsibility regarding (but not limited to) any offers, entitlements, discounts, vouchers and/or privileges, nor the availability or unavailability of such products or services for any reason.  

 

7.4. e-SIM  

 

7.4.1. While the e-SIM Service is purchased from and provided by Dragonpass, it is supplied by a third-party provider, e-SIM Go.  

 

7.4.2. Eligible Dragonpass Members will be able to access this Service and search for, purchase, and top-up their e-SIM balance in the Dragonpass App.  

 

7.4.3. The Service is provided entirely at Dragonpass’ discretion and only selected Cardholders are eligible for the Service.  

 

7.4.4. Dragonpass reserves the right not to provide the Service to any Users who fail to meet the eligibility requirements.  

7.4.5. Dragonpass Members have the option to purchase the e-SIM Service through the Dragonpass App on a pay-as-you-go (“PAYG”) basis, including top-ups.  

 

7.4.6. All applicable prices will be reflected on the Dragonpass App and Dragonpass reserves the right to amend the applicable prices from time to time in its sole discretion without notice.  

 

7.4.7. Dragonpass Members are entitled to unlimited purchases of the e-SIM Service and all purchased e-SIM data plans are valid for a period of 1 (one) year from the date of purchase, after which it shall automatically expire.  

 

7.4.8. The validity period mentioned above shall be applicable regardless of whether you use the purchased e-SIM data or not, and you shall under no circumstances be entitled to a refund for any unused e-SIM data.  

 

7.4.9. Once purchased, a confirmation email will be sent to the email address provided at the time of purchase, and a corresponding SMS notification will also be sent to the cell phone number provided at the time of purchase.  

 

7.4.10. By agreeing to these Terms, you agree to provide Dragonpass with the right to send the above emails to the email address provided at the time of purchase, as well as a corresponding SMS notification to the cell phone number provided at the time of purchase. This is a condition of use of the Service.  

 

7.4.11. Once confirmation of payment has been received, you will be entitled to use the Service.  

 

7.4.12. The Service is supplied by a third-party provider, e-SIM Go. You acknowledge that while Dragonpass provides access to the Service, we are in no way responsible for the management and supply thereof and therefore Dragonpass will in no way be liable for any damages and/or losses suffered by you through the use of, or in connection with, the use of the Services. In addition to the above, Dragonpass also does not warrant as to the performance and capabilities of the Service.  

 

7.4.13. Dragonpass uses multiple network providers with varying levels of connection and speeds. While we will endeavour to provide the best level of connectivity possible, this is ultimately out of our control and we cannot guarantee a specific download or upload speed when using the Service.  

7.4.14. The Service is provided to you on a non-transferable, non-refundable, and non-changeable basis.  

 

7.4.15. A purchase of the Service may be cancelled up to 48 (forty-eight) hours from the time of purchase, with a full refund. You will not be entitled to any refund whatsoever should you cancel a purchase of the Service more than 48 (forty-eight) hours after the time of purchase.  

 

7.4.16. Should you choose to cancel the purchase of the Service within the 48 _forty-eight) hour period mentioned above, you will not be entitled to any refund whatsoever if you have used any of the e-SIM data provided under the purchased Service.  

 

7.4.17. Dragonpass Members that have already installed the e-SIM will still be eligible for a refund upon cancellation, provided that they cancel the purchase of the Service within 48 (forty-eight) hours of the time of purchase and provided that no e-SIM data provided under the purchased Service has been used. 

 

7.4.18. By using the Service, you agree to abide by the rules, policies, and terms and conditions of e-SIM Go, and agree to the standard Terms and Conditions of Dragonpass applicable to the Service.  

 

7.4.19. You acknowledge that, as the Service is provided on a PAYG basis, you are solely responsible for all payments and charges in relation thereto. Dragonpass shall not be liable for any charges in relation to the Service.  

 

7.4.20. You acknowledge that the Service is subject to availability. 

 

7.4.21. You expressly accept and agree to all terms and conditions of use that are applicable to the e-SIM Service. These terms and conditions may be amended from time to time by Dragonpass in its sole discretion without any notice to you.  

 

7.4.22. Dragonpass shall not be liable for or take part in any dispute that may arise between you and e-SIM Go in relation to the Services.  

 

7.4.23. Dragonpass is not responsible for, nor does it provide a warranty as to, the goods and services accessed and provided by e-SIM Go.  

 

7.5. Fast Track  

7.5.1. You can book your access to Participating Merchant Outlets’ Fast Track lanes available to Dragonpass Members via the Dragonpass App. Prices may vary depending on the location of the Fast Track lane in question.  

 

7.5.2. To check whether the Fast Track lane you intend to use can be booked in advance, Users are required to check the Dragonpass App, where you will be able to search whether a booking is available at your desired time of access. 

 

7.5.3. As part of the booking process, you will need to submit the following details:  

 

a) the airport and departure terminal for the Service;  

 

b) the date and time slot that you wish to use the Fast Track security lane; and  

 

c) the number, and name(s) of your additional travelling Fast Track passengers.  

 

7.5.4. Please note that some airports and railway stations do not charge for children under a certain age. The applicable age requirements will be displayed in the text under the relevant Fast Track location. It is your responsibility to check this information before proceeding. Please take the time to read and check your order at each page of the booking process. You will then be asked to submit your payment information and confirm your order.  

 

7.5.5. All Fast Track bookings are subject to availability and the Participating Merchant Outlets providing the Fast Track Service at airports and railway stations reserve the right to withdraw availability of the Service at their sole discretion for a given date or period. Dragonpass will however update the Dragonpass Website and App within a reasonable time to reflect any such changes accordingly, so please ensure that you check before travelling to ensure that your chosen Fast Track lane is still available to book in advance.  

 

7.5.6. Payment must be made in advance and online. We reserve the right not to fulfil your booking if your card is declined for any reason whatsoever or if the payment card has been used, or is suspected to have been used, fraudulently.  

 

7.5.7. The price you pay is the price accepted and confirmed to you during the online booking process. Pricing for all Fast Track passes will be in USD (US Dollars) and is subject to change. Pricing includes Value Added Tax (“VAT”) and all other applicable taxes. The booking is valid for a single passage through the Fast Track security lane for the date you have booked.  

 

7.5.8. When you have completed your booking and have provided all the necessary details, you will be provided with an eTicket which may include a QR code/barcode/access code or a message for the Fast Track staff, that will be available via your online Dragonpass Membership account. We will also send you an email confirmation of your booking. You can also print the confirmation and use that for access if that is more convenient for you.   

 

7.5.9. For Fast Track access, please scan your barcode at the eGate screen to access the lane or alternatively show your booking on the eTicket/QR code or confirmation email to a member of staff at the security gate. Some airports may require you to provide your boarding pass and Fast Track confirmation to a member of staff at the security access gates in order to use the Service.  For the avoidance of doubt, stand-by and crew tickets will not constitute valid boarding passes and will not entitle you to enjoy this Service.

 

7.5.10. Your Fast Track security lane access is valid for 1 (one) use only and is only valid on the date and time of travel that you selected when making your booking. For Fast Track access, you must make a booking for each passenger that you are travelling with, unless they are a child who meets the criteria for free entry, as the number of passengers you make a booking for will be reflected in your booking, eTickets/QR code and confirmation email. The airport or railway station will not be able to permit access to any additional passengers on the day.  

 

7.5.11. If an amendment to your booking is required, you must cancel the existing booking and create a new booking.  

 

7.5.12. Cancellations are subject to the terms and conditions of the Participating Merchant Outlet airport or railway station and your booking. We reserve the right, if prevented from supplying the Fast Track security lane service for any reason, to cancel the booking. We will attempt to provide as much notice as is reasonably possible in such instances. Where it is not reasonably possible, we will cancel the booking and refund the payment received in respect of the booking to the card used for payment, but will not be responsible for any other costs (including, without limitation, any card transactional fees or currency conversion losses), which you may incur as a result thereof.  

 

7.5.13. Where cancellations are permitted, a refund will be automatically issued, with the payment being returned to your account. Refunds of bookings will be processed within 10 (ten) working days and will be issued to the payment card used for the booking.  

 

7.5.14. If you don’t attend the Fast Track lane or are refused access because you have arrived later than your booked time, or you cancel your pre-booking less than 72 (seventy-two) hours in advance of your scheduled visit, you will not receive a refund of your booking fee and you will be deemed to have used your booking.  

 

7.5.15. Dragonpass does not accept liability for any failure by us to perform our obligations herein these Terms due to force majeure or any event beyond our reasonable control. A non-exhaustive list of such events includes war or threat of war, riots, civil strife, terrorist threats or activity, industrial disputes, natural and/or nuclear disaster, fire, adverse weather conditions, government regulations, crown instruction, closure, or congestion of airports, and/or cancellation or changes of schedules by airlines or railway operators.  

 

7.5.16. The Fast Track security lane allows you entry to a separate channel into the security screening area. Once you have proceeded through the Fast Track lane and entered the security search area, you are subject to the same rigorous security checks that all passengers must undertake. The same restrictions apply to items prohibited in your hand luggage and on the size and type of liquids you are allowed to carry.  

 

7.5.17. Neither the Merchant Participating Outlets’ airports and railway stations, nor Dragonpass, guarantee the availability of the Fast Track Service or a maximum or minimum queue length or time, or that the Fast Track queue time will be less than the standard lanes. Regardless of whether you purchase the Fast Track Service or not, all passengers are subject to the same security procedures and regulations, and we therefore recommend that you allow enough time for the standard security and x-ray screening. 

 

7.5.18. In the event that you booked a Fast Track Service and/or any other of our products or Services, please note that each Service or product operates independently of each other. Accordingly, when you book a Fast Track Service, we and our Participating Merchant Outlets for Fast Track are only supplying you with the Fast Track Services per se, and we and our Participating Merchant Outlets will not be responsible for any costs, compensation costs or expenses relating to any flights or other Services that you may have arranged. You are responsible for ensuring that you allow sufficient time for car parking, transfer to terminal, airport or railway procedures (including but not limited to checking-in and security) and any subsequent flight/travel arrangements. Neither Dragonpass nor the Merchant Participating Outlets’ airports and railway stations shall be responsible for any passengers who miss their flight or train because they did not allow enough time to go through the check-in and security process. All applicable security procedures, rules and regulations apply to their full extent and such access will be governed strictly in accordance therewith.  

 

7.5.19. The Merchant Participating Outlets’ airport or railway station and its servants and agents reserve the right to refuse admittance to the Fast Track security lane (as applicable) in their sole discretion.  

 

7.5.20. All personal data that is collected as part of the booking process is used in accordance with our Privacy Policy.  

 

7.6. Fitness  

 

7.6.1. Fitness Services are provided to Dragonpass Members via third-party providers including, without limitation, Pindor Group Limited trading as “Boddy”. Dragonpass reserves the right to add or remove additional third-party providers in the future without notice.  

 

7.6.2. You can book your access to Participating Merchant Outlets available to Dragonpass Members via the Dragonpass App. Prices may vary depending on the location of the Participating Merchant Outlet in question.  

 

7.6.3. Dragonpass Members can use their entitlements, if available, to access Fitness Services, including but not limited to gym classes and single-use day passes. Alternatively, you can access such Services on a PAYG basis. Single-use day passes may only be used once on the booking date and time chosen by you.  

 

7.6.4. In order to use the Service, you will be required to use the Dragonpass App to check in at the relevant Participating Merchant Outlet. You are therefore required to bring your cell phone or mobile device with you to the Participating Merchant Outlet, and you will need to connect to the Dragonpass App using either WiFi or mobile data. In the event that you are unable to connect to the Dragonpass App, the Participating Merchant Outlet may refuse your entry and use of the Service.  

 

7.6.5. Some Participating Merchant Outlets do not provide instant booking confirmation. In such instances, you will receive an acceptance or rejection of your booking within 6 (six) hours of making the booking.  

 

7.6.6. You are entitled to cancel a Fitness Service up to 2 (two) hours prior to the scheduled use of the Service and/or scheduled time of a fitness class in order to be eligible for a refund. Should you fail to cancel the Service at least 2 (two) hours prior to the scheduled use thereof, you will not be entitled to cancel or reschedule that Service and will not be entitled to a refund.  

 

7.6.7. For gym single-use day passes, you are entitled to cancel the Service any time before the closing time on the date on which the Service has been booked in order to be eligible for a refund. If you fail to cancel the Service and do not arrive on the scheduled date, you will be charged for the Service and will not be entitled to a refund. 7.6.8. If an amendment to your booking is required, you must cancel the existing booking and create a new booking.  

 

7.6.9. In the event that you qualify for a refund, entitlement refunds will reflect on your account immediately whereas PAYG refunds can take up to 30 (thirty) days to reflect.  

 

7.6.10. You acknowledge that participation in gym activities and the use of gym equipment involves a certain level of risk, including the possibility of personal injury or death, and voluntarily assume all risks associated with your participation in the Service and release Dragonpass and the Participating Merchant Outlets from any and all liability, claims, demands, or actions arising from any injury and/or death sustained by you while using the Services.  

 

7.6.11. All bookings for the Service must be made in the name of the registered Dragonpass Member. No person may use the Service other than the registered Dragonpass Member and no guests may accompany the Dragonpass Member at this time, although this may be subject to change in the future.  

 

7.6.12. For any questions, complaints or concerns, you will be required to contact the relevant Participating Merchant Outlet directly.  

 

7.6.13. Fitness Services are only available in select cities and countries.  

 

7.6.14. All Participating Merchant Outlet dates and times shown in the Dragonpass Website and App are in the time zone of the country in which that Participating Merchant Outlet is situated and not the time zone in which the Dragonpass Member is situated. This should be considered when making your booking.  

 

7.6.15. Use of the Services is subject to the applicable Participating Merchants Outlet’s terms and conditions.  

 

7.7. Flight Delay 

 

7.7.1. To access this Service, you must register for Flight Delay at the following web address: [insert].  

 

7.7.2. The Service is available to eligible Dragonpass Members only.  

 

7.7.3. The Service is provided entirely at our discretion and only selected scheduled flights are eligible for this Service.  

 

7.7.4. You are required to display your physical or digital proof of registration, together with a valid boarding pass, to enjoy the Flight Delay Service. The name displayed on the proof of registration will also need to correspond with the name displayed on the boarding pass in question. In the event that there is any discrepancy between the name displayed on the proof of registration and the boarding pass, you will not be entitled to enjoy the Flight Delay Service. For the avoidance of doubt, stand-by and crew tickets will not constitute valid boarding passes and will not entitle you to enjoy this Service.

 

7.7.5. Subject to the above, you will become eligible for the Service is you register your flight at least 24 (twenty-four) hours prior to the scheduled departure time. We reserve the right not to provide the Service should you fail to accurately register your details or the details of your travel companion(s) within the required time period.  

 

7.7.6. Eligible Users will be entitled to unlimited registrations for this Service, and each registration will be valid for 24 (twenty-four) hours from the time of registration.  

 

7.7.7. The departure of your flight will be monitored by our flight tracking system. In the event that our flight tracking system identifies that your flight has been delayed by more than 60 (sixty) minutes (the “Delay Threshold”), and subject to successful prior registration and lounge availability, the Service will provide you with airport Lounge access via email. You will also receive an SMS notification of such emails.  

 

7.7.8. The email mentioned above will be sent to the email address provided at registration and the corresponding SMS notification will be sent to the cell phone number provided at registration.  

 

7.7.9. By agreeing to these Terms, you agree to provide Dragonpass with the right to send the email mentioned above to the email address provided at registration, as well as a corresponding SMS notification to the cell phone number provided at registration. This is a condition of use of the Service.  

 

7.7.10. Both Dragonpass and the User will rely solely on our flight tracking system to determine whether you are eligible for the airport lounge access. You acknowledge and accept that we do not warrant the accuracy of the flight tracking system, and you should not rely on it for the purpose of tracking your departure time.  

 

7.7.11. Should you choose to rely on our flight tracking system to determine your departure time, Dragonpass shall not be liable in any way for any damages and/or losses incurred as a result of, or in connection with, missing your flight.  

 

7.7.12. If eligible, the Service will be provided to you. The Service may not be used on any day other than the day of registration.  

 

7.7.13. Only the individual named in the Flight Delay email confirmation will be eligible for airport Lounge access.  

 

7.7.14. The Service is provided to you on a non-transferable, non-refundable, and non-changeable basis.  

 

7.7.15. Registrations for the Service may not be cancelled less than 24 (twenty-four) hours prior to the scheduled flight.  

 

7.7.16. By accessing the relevant airport Lounge, you agree to abide by the rules, policies, terms and conditions of that Participating Merchant Outlet, and agree to the standard Terms and Conditions of Dragonpass applicable to Lounge Services, as contained herein.  

 

7.7.17. You acknowledge that while Dragonpass provides access to certain airport Lounges, we are in no way responsible for the management thereof and therefore Dragonpass will in no way be liable for any damages and/or losses suffered by you through the use of, or in connection with, such Lounge Services.  

 

7.7.18. You acknowledge that certain additional dining options and business or conference facilities available to Lounge guests may be subject to additional charges. Should you choose to make use of any such services, you will be solely responsible for such additional charges. Dragonpass shall not be liable for any additional charges howsoever arising.  

 

7.7.19. You acknowledge that access to a particular Lounge is not guaranteed and is subject to availability.  

 

7.7.20. You expressly accept and agree to all terms and conditions of use that are applicable to the Service and acknowledge that such terms and conditions may be amended from time to time by Dragonpass in its sole discretion without any notice.  

 

7.7.21. This Service is free. Dragonpass reserves the right however to charge a fee and/or amend such fee from time to time in its sole discretion without notice.  

 

7.7.22. Dragonpass shall not be liable for or take part in any dispute that may arise between you and a Participating Merchant Outlet in relation to the Service.  

 

7.7.23. Dragonpass is not responsible for, nor does it provide a warranty as to, the goods and services accessed through and provided by the Participating Merchant Outlets.  

 

7.8. Limousine  

 

7.8.1. All Limousine Services are required to be reserved at least 48 (forty-eight) hours in advance of the scheduled service time via the Dragonpass App.  

 

7.8.2. You can reserve Limousine Services on behalf of others who may or may not be a Dragonpass Member.  

 

7.8.3. There may be a 20% (twenty per cent) surcharge for all Limousine Services booked between the hours of 21h00 to 08h00.  

 

7.8.4. Cancellations may be done via the Dragonpass App.  

 

7.8.5. Any cancellation or changes to the Limousine Service must be done at least 24 (twenty-four) hours in advance of the scheduled Service time in order to be eligible for a refund.  

 

7.8.6. Refunds for any validly cancelled Limousine Service reservations will be issued to the payment card used to purchase the Service and may take between 7 (seven) and 14 (fourteen) business days to be processed.  

 

7.8.7. No additional pick-up and/or drop-off points are allowed for all Limousine Services. Your booking will only cover the address and airport you selected when making your booking. Any requests to add an additional stop will be denied.  

 

7.8.8. Dragonpass Members are required to ensure that you enter the correct number of passengers and luggage when making a booking, as this will determine the car size. Any additional persons and/or luggage may not be permitted into the vehicle.  

 

7.8.9. The waiting times for the Limousine Service are set out below:  

 

a) Pick-up from Airport: Your driver will wait at the arrivals hall for 60 (sixty) minutes from the scheduled pick-up time. If you fail to meet the driver within the 60 (sixty) minute waiting time, the Limousine Service will be cancelled, and no refund will be given.  

 

b) Drop-off at Airport: Your driver will wait at your specified address for 15 (fifteen) minutes from the scheduled pick-up time. If you fail to meet the driver within the 15 (fifteen) minute waiting time, the Limousine Service will be cancelled, and no refund will be given.  

 

7.9. Extra mileage charges, baby seats, holiday surcharges and/or special event prices may be applicable to the Service and will vary from location to location.  

 

7.10. Dragonpass is not responsible for any passengers arriving late to the airport which results in such passenger being denied check-in or boarding of the aircraft.  

 

7.11. Dragonpass will not be liable for any items left in vehicles, traffic delays, mechanical problems, weather, etc., or any events outside of its reasonable control. The Dragonpass Member utilizing the Limousine Service is fully responsible for taking care of his/her belongings when using the Service.  

 

7.12. No smoking, storing and/or consuming of illegal drugs, is allowed in Limousine vehicles at any time whatsoever. Should you fail to comply with the above, you shall be fully liable for any legal sanctions imposed by applicable law, as well as any fines, penalties, damages, losses and/or costs that may be suffered by the Limousine driver and/or Dragonpass due to your breach of the foregoing.  

 

7.13. The driver of the Limousine is responsible for the safety of the vehicle, and compliance with all applicable laws, regulations, and guidelines (including, but not limited to, road safety requirements). If the Dragonpass Member’s (or his/her guests’ or companions’) conduct is potentially in breach of any laws and/or statutory regulations, or causes any potential safety issues, or may potentially cause damage to the vehicle, the Limousine driver shall be fully authorised to remove the Dragonpass Member (and his/her guests’ or companions’) from the vehicle immediately, and no refund will be provided. The Dragonpass Member will be fully liable for any damage caused to the vehicle, any damage caused to any third party’s vehicles and/or other property, as well as any injuries suffered by the driver and/or any other third parties, due to the Dragonpass Member’s (or his/her guests’ or companions’) conduct.  

 

7.14. Dragonpass reserves the rights to adjust the mileage and price in relation to the Service, remove locations and/or add new locations to the list of Participating Merchant Outlets from time to time in its sole discretion without any prior notice.  

 

7.15. Multi-purpose Vouchers  

 

7.15.1. Multi-purpose Vouchers (“MPV”) is a product designed to offer eligible Dragonpass Members greater flexibility by allowing them to redeem Lounge entitlements at selected Dining and Retail locations.  

 

7.15.2. Dragonpass Members eligible for the MPV Service are entitled to exchange their Lounge entitlement for a Dining or Retail Voucher, which can be used at select Participating Merchant Outlets.  

 

7.15.3. If MPV offers are available, they will appear on the Dragonpass App.  

 

7.15.4. Users will be able to view the details of the available MPVs on the Dragonpass App, including the value and currency thereof.  

 

7.15.5. Once a User selects the MPV offer that you would like to redeem, you will be provided with a QR Code that will enable you to redeem the MPV at the applicable Participating Merchant Outlet.  

 

7.15.6. Once an MPV has been redeemed, you will not be entitled to redeem another MPV for 2 (two) hours from the time of redemption.  

 

7.15.7. The MPV Service is subject to availability and is only available to eligible Dragonpass Members at select Dining and Retail locations.  

 

7.15.8. In addition to the above, all standard Terms and Conditions applicable to Dining and Retail Services shall be applicable, as contained herein.  

 

7.16. Retail Discounts and Promotions  

 

7.16.1. All offers, privileges and/or promotions are open to all Dragonpass Members unless otherwise stated.  

 

7.16.2. To enjoy the offers, please present your digital Dragonpass redemption page. A list of Participating Merchant Outlets is available on the Dragonpass Website and App.  

 

7.16.3. All offers, privileges and/or promotions are subject to availability and a while-stocks-last basis.  

 

7.16.4. All offers, promotions and discounts listed may be subject to prevailing government taxes and service charges, where applicable.  

 

7.16.5. All offers, discounts and promotions are not exchangeable for cash, credit or other goods and services and are non-transferable.  

 

7.16.6. Please present your digital Dragonpass redemption page prior to ordering or payment.  

 

7.16.7. All complimentary gifts or items (if any) are provided on a while-stocks-last basis and are not refundable or exchangeable for cash, credit or other items of any kind and are not transferable.  

 

7.16.8. Dragonpass and its Participating Merchant Outlets reserve the right to replace any complimentary gift or item (with an item of similar value) if it is unavailable at the time of purchase/confirmation of order, where applicable, without prior notice to Users.  

 

7.16.9. All offers, promotions or discounts listed are subject to the applicable Participating Merchant Outlet’s terms and conditions.  

 

7.16.10. Participating Merchant Outlet’s reserve the right to amend the terms and conditions governing the offers, discounts or promotions at any time without prior notice. 

 

7.16.11. Goods and/or services (including any complimentary gifts) are provided solely by the Participating Merchant Outlets, under such terms and conditions as determined by such Participating Merchant Outlets, and accordingly Dragonpass makes no warranty or representation as to the quality, merchantability or fitness for purpose (even if advised in advance of such purpose) of the Participating Merchant Outlet’s goods and/or services (including any complimentary gifts).  

 

7.16.12. All disputes or feedback in relation to the goods and/or services of the Participating Merchant Outlets (such as quality, taste, etc.) should be directed to the relevant Participating Merchant Outlet and resolved directly between the Dragonpass Member and the Participating Merchant Outlet. However, for the avoidance of doubt, the Dragonpass Member’s entitlement to benefits such as retail discounts, vouchers, etc., as reflected in his/her Card Account are correct, and as such, please do not raise any disputes with the Participating Merchant Outlets regarding your Dragonpass Membership entitlements as they will not be able to assist you in this regard.  

 

7.16.13. Dragonpass’ decision on all matters relating to the offers, discounts and/or promotions shall be final and binding and no further correspondence will be entertained in regard thereto.  

 

7.16.14. Dragonpass reserves the right to amend, revoke, vary or add to the terms and conditions of any promotion or terminate any promotion or any of its governing terms in its absolute discretion at any time without any liability.  

 

7.16.15. Dragonpass shall not be liable for any misuse, damage or death in relation to any promotional item, discount or offer, and any such instances will need to be raised directly with the relevant Participating Merchant Outlet. 

 

7.17. Standard Lounge Access  

 

7.17.1. You are required to display your physical or digital Dragonpass Membership Card, together with a valid boarding pass, to enjoy the Lounge Service. The name displayed on the Dragonpass Membership Card will also need to correspond to the name displayed on the boarding pass in question. In the event that there is any discrepancy between the name displayed on the Dragonpass Membership Card and the boarding pass, you will not be entitled to enjoy the Lounge Service. For the avoidance of doubt, stand-by and crew tickets will not constitute valid boarding passes and will not entitle you to enjoy this Service.

 

7.17.2. An updated list of lounges is available on the Dragonpass Website and App.  

 

7.17.3. All free Lounge visits provided under your Dragonpass Membership will be valid until your Dragonpass Membership has expired or as stated otherwise.  

 

7.17.4. All purchased Lounge visits may be used until the Dragonpass Membership is expired.  

 

7.17.5. All purchased single-use Lounge access passes shall be valid for 90 (ninety) days from the date of purchase.  

 

7.17.6. All purchased single-use Lounge access passes purchased from the Dragonpass Website or App are non-refundable.   

 

7.17.7. Your guests are required to be on the same flight as the Dragonpass Member to enjoy Lounge access using the same Dragonpass Membership.  

 

7.17.8. Dragonpass may amend the Lounge visit charges from time to time in its sole discretion and the latest charges listed on the Dragonpass Website and App shall at all times prevail.  

 

7.17.9. Lounge maximum stay time varies from lounge to lounge. Once the stay period (usually 2 [two] hours) has lapsed, you will be required to re-register your entry (subject to availability) at the Lounge reception. It is your responsibility to check the maximum stay time and relevant terms and conditions applicable to a specific Lounge before entering. 

 

7.17.10. Availability of Lounge Services is subject to the capacity of the Participating Merchant Operators and Lounges may not be available in the event of high traffic caused by flight or train delays or other reasons outside the reasonable control of Dragonpass. 

 

7.17.11. Dragonpass will not be liable for any losses caused or incurred by missing of flights or flight delay due to the use of Lounge Services.  

 

7.17.12. You will be liable for any damage to the Participating Merchant Outlet, or its premises, caused by your actions while using the Lounge Service.  

 

7.17.13. You may request to terminate your Dragonpass Membership or cancel any reserved Lounge Service visit by calling our customer hotline, alternatively your Provider’s staff will be assigned to assist you.  

 

7.17.14. Participating Merchant Outlet staff will record your details and communicate them to Dragonpass. This information will be used for record keeping, tracking usage and billing purposes, where appropriate.  

 

7.17.15. Please note that any food and/or drinks, including alcoholic drinks (if any), provided as part of the Lounge Service are only for consumption in the Lounge in question and are not to be taken outside of that Lounge. The selection of food and drinks is provided in the sole discretion of the applicable Participating Merchant Outlet and we therefore recommend that you contact the Participating Merchant Outlet in question in advance of your travel if you or any member of your party has any dietary requirements.  

 

7.17.16. The facilities and amenities of the Lounges will vary, and at certain times may be limited. Dragonpass has no responsibility for and is not able to control or dictate the provision of facilities and amenities within individual Lounges. If you require more information in this regard, please refer to the terms and conditions set by each individual Participating Merchant Outlet.  

 

7.17.17. Lounges may be added or removed at any time without notice. The latest list of Lounges is displayed on the Dragonpass Website and App.  

 

7.17.18. Lounge Pre-Booking:  

a) You may elect to pre-book access to certain participating Lounges by using the Dragonpass Website and/or App. Should you choose to do so, you can either pay for each visit or use a complimentary Lounge visit (if applicable) plus a pre-booking fee for each person you book for, including yourself.  

 

b) Pre-booking is only valid at selected airports and Participating Merchant Outlets.  

 

c) Pre-bookings must be made by the relevant Dragonpass Member and the Dragonpass Member needs to be in attendance in order for the pre-booking to be fulfilled. 

 

 d) A Lounge will not be obligated to fulfil any pre-booking in the absence of the Dragonpass Member in whose name the pre-booking was made.  

 

e) Once a pre-booking has been made, you will receive a confirmation email with your reservation details.  

 

f) Dragonpass Members may not resell or transfer any booking (in whole or in part) to any third party. 

 

g) You can pre-book up to 5 (five) guests, including yourself. Children who are subject to free entry at the Lounge do not need to be included in the pre-booking.  

 

h) The pre-booking is valid for a single Lounge entry at the specific Lounge selected during the pre-booking process.  

 

i) All pre-bookings and cancellations must be made at a minimum of 48 (forty-eight) hours in advance of your scheduled arrival date and time in order to qualify for a refund. If you cancel your Lounge Service less than 48 (forty-eight) hours in advance of your scheduled arrival date and time, you will not be eligible for a refund for any part of the booking. Pre-bookings cannot be changed or amended once made. If you need to change your pre-booking, please cancel and make a new pre-booking.  

 

j) If the Dragonpass Member arrives earlier than their pre-booked time, the Lounge may refuse entry until your scheduled time on the pre-booking. If you are late for your pre-booking, the Lounge will allow you entry to the Lounge for up to 1 (one) hour after the pre-booking time. In the event of a no-show, you will not be eligible for a refund for any part of the booking. If your flight is delayed or for whatever reason you wish to remain in the Lounge, you may be able to stay in the Lounge, subject to availability. The Lounge is within its right to ask for additional payment for an extended stay for you and all persons in your group.  

 

k) Pre-bookings are subject to the opening dates, times and availability of the Lounges.  

 

l) Pre-booking availability and fulfilment is subject to the standard terms and conditions applicable to Lounges as set out in these Terms and Conditions, as well as the Dragonpass Terms of Use.  

 

m) Dragonpass will not be held liable for any non-fulfilment of any pre-booking that does not comply with these Terms and Conditions, or the above-mentioned Terms of Use. 

 

 n) Dragonpass will not be liable for any items left in the Lounge or any events which may cause you to be delayed for your booked date and time including, but not limited to, cancelled flights, traffic delays, and/or weather.  

 

8. Dragonpass Right to Amend  

 

8.1. Dragonpass reserves the right to amend these Terms from time to time in its sole discretion without any notice to you. The updated Terms will be uploaded on the Dragonpass Website and App and it is your responsibility to check them regularly to ensure that you agree to comply with them.  

 

8.2. If you do not agree with these Terms, you may stop using our Services at any time. Once you continue to use any of our Services, it is implied that you have agreed with all the Terms contained herein.

9. Liability for Breach of Contract  

 

9.1. By agreeing to these Terms, you have agreed to safeguard the interests of Dragonpass and other Users. If you are found to be in breach of any law, rules or these Terms that causes damage or loss to Dragonpass or any third party in any way, you will be solely liable for all damages and/or losses incurred.  

 

9.2. If you suffer any loss due to a service disruption caused by the negligence and/or wilful misconduct of Dragonpass, Dragonpass will only be liable for any direct loss caused by said service disruption, subject to the limitation of liability as set forth in Section 10 below.  

 

10. Limitation of Liability  

 

10.1. In no event will Dragonpass be liable for any direct, indirect, special, punitive, exemplary, or consequential losses or damages of whatsoever kind arising out of your use of or access to our Services, including loss of profit or the like whether or not in the contemplation of the parties or whether based on breach of contract, tort (including negligence), product liability, or otherwise.  

 

10.2. The entire liability of Dragonpass in aggregate and your exclusive remedy with respect to the Services, associated products, facilities or otherwise, shall be re-performance of defective Services. In jurisdictions which do not allow the exclusion or limitation of certain types of liability, our liability will be limited to the maximum extent permitted by law. We do not endorse, warrant or guarantee any material, product or service offered through us or our Services. We are not and will not be a party to any transaction between you and any third party (including without limitation between you and a Participating Merchant Outlet as our Services simply procure for you access to the Services but we do not provide or manage the Services themselves).  

 

10.3. Without prejudice and subject to Clause 10.2 (which shall take precedence unless applicable law does not permit its application whether in whole or in part), under no circumstances howsoever arising related to the Services or these Terms, their performance or any omissions, shall the aggregate liability of Dragonpass exceed USD 100 (one hundred US Dollars). 

 

10.4. For the avoidance of doubt, Dragonpass shall not be liable to you for any damage or alteration to your equipment including but not limited to computer equipment, handheld devices, or mobile telephones, as a result of the installation or use of the Dragonpass App. 

 

10.5. Nothing in these Terms shall exclude or limit Dragonpass’ liability for death or personal injury caused by Dragonpass’ negligence, wilful misconduct, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under the applicable law.  

 

11. Termination  

 

11.1. Dragonpass may terminate the use of the Services at any time by giving notice of termination to you, whether via the Dragonpass App or to your email.  

 

11.2. Upon any termination:  

 

11.2.1. The rights and licenses granted to you herein shall immediately terminate; and 

 

11.2.2. You must cease all use of the Dragonpass Website and App and any related software.  

 

12. Governing Law and Jurisdiction  

 

12.1. These Terms and Conditions shall be governed by the laws of England and Wales and accordingly you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

Dragonpass App Survey Prize Draw

Eligibility

The prize draw is open to users of the Dragonpass app who complete the survey and provide a contact email address and give their consent to be entered into the draw. Entrants must be aged 18 or over. 

 How to Enter 

To enter the prize draw, participants must: 

  • Complete the designated survey hosted on https://form.typeform.com/to/KXguMW2F 

  • Provide a valid email address on question 3L in the survey, in doing so consenting to being entered into the prize draw. 

Entry Deadline 

The prize draw will close at 23:59 (GMT) on 30th June 2025. Entries received after this time will not be considered. 

Prize 

One winner will be selected at random from all eligible entries. The winner will be contacted to select which one (1) entitlement of their choice they wish to receive, subject to availability and Dragonpass terms of service. 

 Winner Selection and Notification 

The winner will be selected at random within 14 days of the closing date. The winner will be contacted via the email address provided during entry. If the winner does not respond within 7 days of notification, Dragonpass reserves the right to select an alternative winner. 

 Data Protection

By entering the prize draw, participants agree to the collection and use of their personal data (email address) for the purposes of administering the prize draw. Personal data will be handled in accordance with Dragonpass’s Privacy Policy. 

General 

  1. No purchase is necessary to enter the prize draw. 

  2. Only one entry per person is permitted. 

  3. Dragonpass reserves the right to amend or withdraw the prize draw at any time without prior notice. 

  4. The prize is non-transferable and no cash alternative will be offered.
